Online Copyright Infringement: Simple Steps to Protect Yourself From Thieves

The New Media marketplace is all about “sharing” right? Well what about the hard work you’ve done or paid for to create valuable content for your Tribe? You want people spreading the word, but not taking credit for your work. In this video you’ll learn three some simple steps you can take to protect yourself against online copyright infringement without involving an attorney.

It doesn’t matter whether your business delivers services online or off-line — today EVERY business is online attracting customers (or at least should be.) So those are some simple steps to protect yourself against online copyright infringement. It’s something that we all deal with when using New Media marketing to grow our businesses online. Put them into action today by having someone on your team monitoring filters on a daily or weekly basis, and you’ll be protected at least at a base level.

A quick note regarding Google Alerts. You reduce false positives in alert results by using quotes from your work or digital fingerprints that you’ve inserted into your works to uniquely identify it.

There may be instances where getting an attorney involved is necessary, but these initial steps can save you thousands of dollars in attorney fees.

Nike’s New Tiger Ad: Brilliant Marketing or Shameful Act?

Marketing is about controversy. The more controversial, the better the buzz with online video and other New Media channels. And the more bang for the buck you get. But what do you think of the new Nike ad featuring Tiger’s deceased father? Is it brilliant marketing, or shameful exploitation?

The new Nike commercial features a recording of Woods’ deceased father, Earl, gently but firmly admonishing Tiger. The recording was made long before the controversy about his extramarital affairs exploded. Earl Woods, who died in 2006, urges Tiger to live a just life and learn from his mistakes.

Personally I think the whole thing is silly. He slipped up (oooops….OK, lots of “slips”) LOL! . . . but it’s his life. No one but the companies he endorses has the right to judge him and pass sentence. He’s not a politician and holds no responsibility to me or anyone else in the general public. If you feel otherwise, you can judge with your wallet.

Is the commercial shameful? Well, in my opinion; it’s not my dad, it’s Tiger’s. It’s his choice. That aside, all I can say is Nike has gotten more free buzz since the ad was released — with off-line coverage and with online video, New Media and Social Networks — than they have in a lonnnng time.

The New Way to Sell With Online Video

Online video is a killer business tool. Rapport, trust, more sales . . . they’re all possible with online video. But like other New Media online marketing methods — only when it’s done right. What’s the right way? Let’s take a look at a killer 7-minute video example right now and see.

First — tell em’ what you want em’ to do

“The following is a product advertisement. You are going to be bombarded by visuals of great looking products, and then entertained by motorsports eye candy. Do not resist the temptation to purchase the products when prompted to do so. Enjoy!”

When’s the last time you watched an online video that gave you a warning like this right up front? You’d probably expect anyone who made a video like that to have a dozen or so views right?

Well, how about over 13-million views on YouTube alone.

Capturing hearts, minds and pocketbooks

If you’re not in the target audience I hope you can see what was done here. If you fall into the target audience, you felt it.

The formula is simple. Know your audience and their wants, needs and dreams. Then stir emotions so deeply that your products stick in their minds, then and only then will you win both their pocketbooks and loyalty in today’s cluttered marketplace.

Simple isn’t always easy — unless you make it hard

Don’t get hung up on the production quality of this video. Don’t focus on not being able to drive a 600hp car sideways at 100mph you’ll miss the point. It’s the principles encapsulated in this video that are immediately applicable, no matter what your budget or driving skills.

For one thing, you should get the point that you CAN blatantly promote your product or brand using New Media in your online marketing . . . IF you give value in return. In fact, I argue that if you try to “fool” people with a bait and switch, or  beat around the bush — that will kill any chance of your getting results with your videos.

On the other hand, did you notice the subliminal product positioning throughout?

AFFILIATES BEWARE: Will Your State Kill Your Business with the Amazon Tax?

affiliate nexus taxColorado just killed thousands of small businesses whose revenues are based on affiliate sales. They follow on the tail 3 other states with similar laws in place already, and 14 more states nipping at their heels. Here’s why, whether you are an affiliate, or you run an affiliate program, you need to know how this rabid pack of looters can do serious damage to your business, maybe even kill it all together.

Amazon first to fight back . . .

When Colorado passed this new onerous tax law, they forced Amazon’s hand. With one of the world’s largest affiliate programs, Amazon had learned from their experience with New York state when NY passed an Affiliate Nexus Tax. Amazon immediately notified every affiliate in Colorado that they were canceling their affiliate referral program in the state.

Basically they called Colorado’s bluff (CO didn’t think they would ever do what they did) and in the process they took a stand for us all.

You see, New York, along with North Carolina and Rhode Island have enacted laws saying that if a retailer runs an affiliate program with referral payments, that’s enough to trigger tax collection requirements. It has to do with “nexus”, which we’ll get to in a minute.

California, Illinois, Iowa, Maryland, New Mexico, Vermont, and Virginia are among those states with similar measures currently pending; in Virginia, one chamber of the state legislature has approved the bill.

The law is called the Affiliate Nexus Tax, AKA the “Amazon Tax” for Amazon’s ongoing legal battle with New York state on the unconstitutionality of the law. It’s the latest in a series of efforts to increase taxes by eliminating the long-standing “physical presence” standard and replace it with a nebulous, arbitrary standard of “economic presence.” Physical vs. economic presence is HUGE when it comes to nexus.

But the fact that Amazon has deep pockets and is able to fight this is a help to us all — affiliates and business owners with affiliate programs alike.

Aside from the unconstitutionality of these laws, the ass-backward logic of raising taxes on the businesses on whom the recovery depends, and the over-reaching of states beyond their borders; the most pressing concern you need to have is the language these new tax bills use.
